Is ABRA not playing fair?
Thanks Richard for the information. Although I haven’t yet researched ABRA, the issues discussed by readers posting comments at the above link are certainly interesting. I find it hard to believe that anyone in this profession would purposely try to deceive others by marketing their company as a Not For Profit, when in fact they are not. Does anyone else have any additional information on this.
Wikipedia, the free encyclopedia give us the following information, “A not-for-profit corporation is an incorporated organization created by statute, government or judicial authority and registered at the Registry of Commerce, that is not intended to provide a profit to the owners or members.”
After further research, I can’t find where ABRA is doing anything wrong. It doesn’t appear that ABRA is incorporated or working as a LLC. Based on the information obtained from their website, ABRA is an association only. As such, they can call themselves a non-profit association and not be in violation of any laws, rules or regulations. If they decide to incorporate as ABRA, the not-for-profit designation may not apply.
My questions to ABRA is, if they truely are a non-profit company, why not incorporate and receive the benefits afforded by a corporate umbrella?
Despite what many persons would like to believe, ABRA is NOT a company. It is exactly what its’ name says. It is the American Bio-Recovery ASSOCIATION, incorporated in Delaware as a non profit organization.
As a trade association, it exists to further professionalism in the biorecovery industry and to provide educational and marketing services to its member companies. It cannot perform any biorecovery services, its’ member companies provide services. ABRA is funded through membership, certification and referral fees.
I am saddened that various individuals who have grievances against particular ABRA members have chosen to drag ABRA into their personal business conflicts. Since ABRA is an association and not a franchise operation, it cannot place limits on business related decisions an individual company might make and thus can not be held responsible for those decisions. Doing so would be like holding the IICRC responsible for a bad mold remediation job by a certified IICRC company.
